Plaintiff Arguments [Sep 23, 2009]

1. Luke Skywaler Collectors glass from 1977. Part of my vintage glass collection that I use but never bring outside. Matty comes over, fills it up, walks outside and puts it on a ledge. Man down - Hard to find $20 value.

2.  1 Litre beer mug from my Oktoberfest visit from 1997. Bought it for the equivilant of $30 american. Matty leans back in his chair, half assedly leans forward to place it on the table, underestimates weight and doesnt get it on the table all the way. - man down $35

 

3. Knocks a plate of burgers of the grill. Man down. Only a $5 plate but this is ridiculous.

 

$75 covers the cost to replace the glasses and cover any shipping costs / my time that is needed. He said he would replace them and he never did.

The Star Wars collectors glasses are amazing but it was not fully my fault. I put it on a firm ledge, along with 6 + beer bottles. I go to give a friend a high five to say hello and he punches me in the nuts causing me to fall into the rail. The glass and all the bottles fell off the rail and shattered. I was not drunk nor was I even drinking. The drunk idiots should have to pay for that one. The beer stein is another story and I dont take full blame for that one either. I was not being lazy...Heiny invited over 4 of the hottest girls I have ever seen. I went to be a gentleman and get out of my chair for her when I blindly put my beer mug down. It fell off the table and broke. Chivalry caused my accident. It should be chalked up to me being nice to the ladies. Heiny ended up hooking up with her and it was because I was so nice upon her entrance.

I voted for MattyT on this one. I think he should reimburse you to a certain extent (say, $20), but $75 for 2 glasses and a plate is outrageous. HeinY, you're contributorily negligent and you voluntarily assumed the risk, because you know he's a klutz and yet you let him use expensive glassware time after time. Either restrict him to plastic or assume he's going to break stuff!

Having a rather decent sized collection of collectibles, I can understand asking for $75. But give the defendant time to replace them on his own. He may find exact replicas for under $30, depending on how hard he looks for them.
