Plaintiff Arguments [Mar 9, 2010]

BBlue bought tickets to the Big East conference Championship in anticipation of our alma mater, Georgetown, being a #7 seed meaning they would play a night game. A few wins and losses by other teams dropped them to a #8 seed giving them a different game time. I said I was interested in going but told him from the get-go that I did not think it wise to buy the tickets before we knew exactly what time they would be playing. He did anyway and now he has tickets to games we have no interest in and he is asking me for my share if he cant get rid of them.

This was never my share since I wanted to wait. Yes I was 100% in for going to the game but that is 100% to see GEORGETOWN, not other teams. This is why I wanted to wait so the tickets are your responsibility.

Defendant Arguments [Mar 9, 2010]

You are a coward for not stepping up. Its the same 4 guys each and every year. I get the tickets, everyone joins in. It just so happens that the past 5 years, I have nailed every game and bought the correct tickets. You never thanked me then. But now, in a time where I guessed incorrectly, you want nothing to do with it. If we all pooled our resources, we could have unloaded the tickets easily and broke even. Now I sold them at a loss and none of us are going the game tomorrow. Win some lose some but I have won more for our team of 4 guys than you have ever admitted to. Fair weather fan.

dont buy tickets before you know when your team is playing. you got lucky the last 5 yrs. if there was no agreement to get the money from everyone upfront it's your problem you bought the wrong tickets instead of waiting.

I did take the chance but by waiting it would have cost us $250 more for crap seats. They didnt chastise me for the past 5 years when I got it right and saved them a ton of money.

While they may not have chastised BigBlue previously for buying early, it sounds like this year there were expicit instructions to wait and he ignored them. BigBlue is out of pocket because of the gamble he took and not because of a "fair weather fan".

If by waiting, you would have paid considerably more for terrible seats, what is the problem with finding a buyer for good seats at face value? Put them on craigslist and recoup your loss.

good point rws! i didnt even think of it in that way. yeah, if they were good seats, why can't you sell them for a profit or at least break even? since you said if you waited it would cost you more...wouldnt that be the same for someone who wants to buy the good tickets you bought???
